WASHINGTON – Today, Congressman David G. Valadao (CA-22) joined Reps. Jared Golden (ME-02), Juan Ciscomani (AZ-06), Don Davis (NC-01), Zach Nunn (IA-03), Brian Fitzpatrick (PA-01) and Wiley Nickel (NC-13) to introduce bipartisan legislation that gives the Biden administration temporary expulsion authority resembling operations under Title 42. Senators Kyrsten Sinema (D-AZ) and Tom Tillis (R-NC) have introduced companion legislation in the Senate. Last month, Congressman Valadao joined Senators Sinema and Tillis at the southern border in Arizona to receive an operational update from U.S. Border Patrol.
There are currently hundreds of thousands of migrants lined up at the Southern Border awaiting Title 42’s expiration at 11:59 pm ET Thursday. The Biden administration has deployed an additional 1,5000 U.S. active-duty troops to the U.S.-Mexico border ahead of the expected surge, bringing the total to 4,000 military personnel.
“We’re seeing a humanitarian and national security crisis at our border, with over 1.3 million known evasions in the last two years and record amounts of fentanyl harming our communities,” said Congressman Valadao. “The Biden administration has failed to secure the border, and the expiration of Title 42 is only going to make this situation more dire. This bipartisan, bicameral bill is necessary to give our border patrol agents the tools and time they need to keep our border secure and our communities safe.”
“The situation at our border is already a dangerous crisis and ending Title 42 without resources and a workable strategy in place will only make it worse,” said Congressman Golden. “This bill arms the Administration with the authority to address this crisis.”

Background:
According to U.S. Customs and Border Protection, Title 42 authorities have expelled migrants at the U.S.-Mexico border more than 2.8 million times since the policy began in 2020. With the expiration of Title 42, Border Patrol agents will lean more on Title 8 authority, which has longer processing times and could strain already overwhelmed resources.
